Parents of kindergarten students worry about putting their children on the school bus. They worry about whether they will get hurt on the playground.

It never crosses their mind that their child will be sexually abused by a teacher, a Frederick man wrote in a victim impact statement to Judge G. Edward Dwyer Jr. at the sentencing hearing in Frederick County Circuit Court of Matthew Brian Berresford.

Berresford, 32, remained silent Thursday, the week after entering an Alford plea of guilt to committing a third-degree sex offense against a 5-year-old boy in a North Frederick Elementary School restroom.

An Alford plea is not an admission of guilt but an acknowledgment that had the case gone to trial, the state had sufficient evidence to convict.

Dwyer followed the recommendation of Assistant State’s Attorney Tammy M. Leache — and supported by the child’s parents — to suspend a 10-year prison sentence and place Berresford on five years of supervised probation.

The judge, the prosecutor and the parents were satisfied that by law, because of his conviction, the former teacher will have to remain registered as a child sex offender for life.

A resident of East Berlin, Pa., Berresford was a teacher at the Frederick elementary school for six years, beginning in August 2003.

“Mr. Berresford, I understand the balance that the state and the parents went through (in going along with the plea agreement),” Dwyer said.

“There is a great advantage to not putting (the child) through a trial. It’s better for him to move on.”

Leache said the child’s parents are satisfied knowing that Berresford must register as a child sex offender and that he faces prison time if he violates conditions of probation, which include having no contact with anyone under 18, excluding his daughter.

“These parents are not on a witch hunt,” Leache said. “They liked and trusted Mr. Berresford. They were completely shocked and blindsided by this.”

In the statement, the child’s father wrote that he blames himself for telling his son to always listen to his teacher.

“I feel I let him down and feel like I was not there to protect him when I promised him since the day he was born that I would never let anyone hurt him,” he wrote.

Leache said the child’s parents sought to accomplish two things from the agreement. They did not want their son to have to testify at trial, and they wanted to keep Berresford away from children.

“This agreement ensures that society is protected,” she said.

The parents attended court, but declined to speak beyond the father’s written statement, which they declined to be sealed from the public.

In March, defense attorney Thomas A. Pavlinic said he planned to put on “a vigorous defense” for his client, who “steadfastly denies the allegations.”

Last week, Pavlinic said he gave in to his client’s wishes to accept the offer instead of going on trial next month. Pavlinic was hired by a state teachers union to defend the teacher.

Berresford took a paid leave of absence July 7, 2009, after the boy’s parents reported inappropriate teacher behavior, a school spokeswoman said when allegations surfaced.

Berresford did not return to a classroom, and school officials dismissed him Dec. 21, following an internal investigation.

Under the agreement, Berresford must undergo a psychosexual evaluation and testing and treatment as recommended.

In addition, prosecutors will not pursue charges related to allegations made by another child, a 5-year-old girl at the same school.

The girl’s family did not cooperate with police, making pursuing the case more difficult.

Besides complying with conditions of his probation, Berresford faces one more unknown — whether the state of Pennsylvania will oversee him while he is on supervised probation.

Under the interstate compact, Pennsylvania can choose not to take on Berresford’s case, in which case he would have to relocate to Maryland for his five years of probation.

Dwyer warned Berresford of that possibility. “You’re the type of criminal they don’t like,” he said.
